The agreement
These terms are an agreement between you and the LaunchHeat team, who operate LaunchHeat ("LaunchHeat", "we", "us") at launchheat.com. By using LaunchHeat you agree to them, and to our launch guidelines and privacy policy. If you don't agree, please don't use the service.
Your account
- You need an account to vote, submit a product or report one. Browsing doesn't need an account.
- You must be at least 16 years old to create an account.
- You sign in through a third-party provider (for example Google). Keep that account secure: you're responsible for what happens under your LaunchHeat account.
- One account per person. Creating extra accounts to vote or to launch more products isn't allowed.
Launching a product
- You may only submit a product you made or work on, and you confirm you have the right to list it, including its name and logo.
- Every submission is reviewed by a person. We decide whether and when it goes live, and we may reject it, for example if it doesn't meet the guidelines. Launching is free.
- Once live, your listing, its votes, visitor and click counts, and its rank are public. We don't guarantee any particular rank, number of votes or amount of traffic.
Your content
You keep ownership of everything you submit: your product's name, logo, description and other details. You give us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and share that content to run and promote LaunchHeat, for example on product pages, leaderboards, share images, badges and our social accounts. This licence ends when your listing is removed, except for copies already shared or kept in backups for a limited time.
You are responsible for your content being accurate, lawful and not infringing anyone else's rights.
Fair use and voting
When using LaunchHeat, you agree not to:
- buy, sell, trade or reward votes, or use multiple accounts, bots or scripts to vote, visit or click;
- organise or take part in vote rings, or otherwise try to manipulate rankings;
- submit spam, scams, malware, or illegal, hateful, adult or misleading content;
- scrape the service at a scale that harms it, probe or break its security, or get around rate limits;
- impersonate anyone or misrepresent your connection to a product.
Moderation
To keep the board fair we may, at our discretion, reject or remove listings, stop counting votes we believe were manipulated, and suspend or close accounts that break these terms or the guidelines. Where we reasonably can, we explain why, for example as a rejection reason on your dashboard. Anyone with an account can report a product; reports are reviewed by a person.
Paid placements
We may offer paid promotions, such as sponsored slots. When we do, the price, duration and placement are shown before you pay. Sponsored placements are always labelled and kept separate from the rankings: paying never changes a product's score or rank. Promoted products must still follow the guidelines, and we may refuse or end a promotion that doesn't. Payment and refund terms are shown at checkout.
Other websites
Products on LaunchHeat link to their makers' websites, which we don't control. We aren't responsible for those sites or products, and listing a product isn't an endorsement. Check a product carefully before you buy it or share data with it.
Our service and brand
The LaunchHeat name, logo, design and software belong to us. Makers may use the official "Launched on LaunchHeat" badge and link to their launch page. Please don't use our brand in a way that suggests we endorse you.
Disclaimers and liability
LaunchHeat is provided "as is" and "as available". We work to keep it running and accurate, but we don't promise it will always be available or error-free, or that rankings and counts will be exact.
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue or data, arising from your use of LaunchHeat or of products listed on it. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing. Nothing in these terms limits liability that can't be limited by law.
Ending your use
You can stop using LaunchHeat at any time and ask us to delete your account. We may suspend or close accounts that break these terms. Parts of these terms that by their nature should continue, such as the disclaimers and limits on liability, still apply afterwards.
Changes
We may update these terms as LaunchHeat grows. When we make a material change we'll update the date above and, where appropriate, tell you on the site. Continuing to use LaunchHeat after a change means you accept the new terms.
Governing law
These terms are governed by the laws of [to be added: governing country], and disputes will be handled by the courts there, unless the law where you live gives you the right to bring a claim in your local courts.
